TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NOVARA LIMITADA, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100 USD).

You acknowledge and agree that Novara Limitada shall not be liable for any damage or loss caused by your use of such third-party sites. If you submit any ideas, suggestions, feedback, or other information (“Feedback”) to us through the Site or otherwise, you grant Novara Limitada a perpetual, irrevocable, worldwide, royalty-free license to use, modify, reproduce, and distribute such Feedback for any purpose without compensation to you.

We reserve the right to suspend or terminate your access to the Site, without notice or liability, for any reason, including if you breach these Terms. These Terms shall be governed by and construed in accordance with the laws of the Republic of Costa Rica, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or your use of the Site shall be resolved exclusively through binding arbitration in San José, Costa Rica, in accordance with the rules of the Costa Rican Arbitration and Conciliation Center (Centro de Conciliación y Arbitraje de Costa Rica). The arbitration shall be conducted in Spanish or English, at the claimant’s option. The arbitrator’s award shall be final and binding, and judgment may be entered in any court having jurisdiction. You waive any right to participate in a class action or representative proceeding.
We reserve the right to update or modify these Terms at any time without prior notice. The revised Terms will be posted on this page with an updated “Effective Date”. Your continued use of the Site after any changes constitutes acceptance of the new Terms. We encourage you to review these Terms periodically.
If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, such provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Novara Limitada regarding your use of the Site and supersede all prior agreements and understandings, whether written or oral.
